The Constitutional Court annulled the expression in the Civil Code that banned membership in charitable foundations. Thus, it became possible for everyone to become a member in these institutions.
The decision of the court, which was taken on April 17, was published in the Official Gazette on June 28.
The 101st article of the Civil Code had an expression banning membership in charitable foundations.
The court referred to the 33rd article of the constitution about associations and said that since according this article anyone could become a member in an association without prior permission, the same judgment applied to the charitable foundations as well. The expression was annulled unanimously.
The annulment of this expression in the Civil Code was made possible by the application of the 13th Ankara Court of First Instance and the 1st Gaziantep Court of First Instance. (TK/EZÖ/TB)
